Hello - I was involved in an auto-accident in March of 2006 in which both insurance companies (mine and hers) agreed that it was the other party's fault and I was a zero-liability. Their insurance company (let's call them Venus , of ease) has asked for receipts ($1000 in rentals which my coverage does not cover), my deductible amount and any other amount which I had to put out (total is about $1,700). I have waited since April for them to pay me. I get letters from Venus every other week saying they are pending further investigation - but, I am at wits-end and want my money which I had to pay-out for an accident that everyone acknowledges is not my fault. Does anyone know what the law/rules are in California and how long they can take to pay after they find the other party is at fault? Our company got bought out & our new employer is doing open enrollment for health insurance next year. I currently have roughly a $75 monthly premium with a $500 deductible, then the employer pays 80%. A few weeks ago my car was rear ended and has minor frame damage from the collision. The insurance adjustor's checked it out and offered me $700 to fix the paint on the bumper, repair the bumper support and 2 hours on a frame rack. Details about my car: The passenger rear taillight is pushed in about a centimeter - the quarter panel now sticks out a tad and is crumpled in the wheelwell - my passenger framerail has a warp in it from the accident. Now they are claiming that my car was in a previous accident because of filler paint or something in the trunk. They claim that because I have a hole cut into my frame rail that the car was previously pulled and that's where the damage came from. I drove the car for 4 years, I think I'd know if my taillight was pushed in and my quarter panel was sticking out. They told me to take it to an auto body to have it looked at and they would contact them on a final settlement - BUT I feel the car is unsafe to drive. I do not want to drive a car with previous frame damage (fixed). Would I be able to take the money and buy a different car without the body shop doing work on it?

I live in North Carolina and my Dad lives in Texas. I am going to college close to my mother who current ly insures me. I am not going to have a car for probably 2-3 years, and will literally never drive my moms car when I am at home, but my mom is paying a large amount of money to be on her plan. The insurance people said that you have to be more than 100 miles away from her to be taken off because there is resonable doubt I would drive. I was wondering if state laws allow for me to be insured by my dads plan in Tx, if so, would it cost a lot to be on his? If thats not possible, is there anyway to be taken off my moms or to not be insured at all?

Insurance cant get a hold of the other at fault party, what do?

I was involved in a traffic collision where I was rear ended by another vehicle. Police report was filed, the information was traded. I filed a claim with their insurance and mine and have not herd anything from the other party. Everyday I contacted their insurance and they still cant get a hold of him. My vehicle is not in drivable condition so I am forced to wait, since I do not have money at this moment to pay for my deductible, I just stared a new semester and spent close to $800 on books. To make matters worse my work has come to a standstill and no income is flowing. I am thinking about hiring an attorney to help me recover the losses. What should I do? If the guy never responds what happens? Is there a law which states how long the other individual has to file a claim? Thank you. I live in the state of California.

right now I can't afford insurance but will be required to buy it anyway starting in 2014, I am curious as to how much it will be.
